The present general conditions govern the provision of independent services offered by Upscale Tours, such as guided tours, personalized assistance, event services, themed activities, and cultural accompaniment services, both in Spain and Portugal.
Upscale Tours offers to create your private experience in Spain or Portugal according to your desires and puts at your disposal to inspire you different ideas of experiences to help you make the best choice (museums, palaces, stadium, bike ride, segway ride, gastronomic visit…). You can find these inspirations on the Upscale Tours website as well as on various communication media (Facebook, Instagram).
To obtain more information on the tailor-made experiences we offer, we invite you to submit a request.
As soon as you wish to confirm your tailor-made experience, within its validity period, Upscale Tours will send you an email formalizing your à la carte booking. As soon as you have confirmed your final agreement on your experience, we will proceed to book it with our various partners. Tailor-made experiences involve constantly adjusting the services that are purchased according to the wishes of our customers.
1 - Nature of the Service
The services offered do not constitute a travel package and are not sold as a combined offering. Each service is managed, offered, and invoiced independently, in the client’s name and according to their specific request. Upscale Tours does not market accommodation, air transportation, or integrated tourism products, and is therefore not considered a travel agency under the applicable Spanish and Portuguese regulations.
2 - Methods of payment - invoices
The indicated prices include operational costs, administrative management, personalized consultancy, and applicable fees. VAT will be itemized as applicable in each case. Payments may be made via bank transfer, credit card, or secure electronic platforms.
3 - Cancellation and Modification Policy
All cancellations must be communicated in writing as far in advance as possible. Depending on the specific service and provider, particular conditions may apply, which will be communicated in advance. It is important to note that when booking multiple activities, we will provide you with the cancellation conditions specific to each service provider. Since we do not sell packages, we do not have a single cancellation policy but rather several. These will be communicated to you at the time of booking.
4 - Limitation of Liability
Upscale Tours acts as a direct organizer only when personally providing a service. In cases where services are contracted through third parties (such as freelance guides, professional drivers, or ticket providers), its role is solely that of an intermediary. It does not assume responsibility for incidents attributable to third parties, unless expressly stated otherwise in writing.
5 - Applicable Law and Jurisdiction
These conditions are governed by Spanish law. For any dispute or interpretation, the parties shall submit to the Courts and Tribunals of the service provider’s as legally appropriate.
